Post-nupital Agreements
Similar to a pre-nup, a couple can agree to the division of property, alimony, etc. in a post-nuptial agreement. Post-nuptial agreements are simply agreements that are executed after the marriage. Any agreement executed after a divorce has been filed is referred to as a reconciliation agreement. You can mediate to stay married and renegotiate any existing terms.
If they are executed after a divorce filing and are executed in conjunction with a reconciliation they are referred to as reconciliation agreements.
Post-nuptial Agreements can be obtained by any married couple in the Georgia, including:
- Parties who want to change the terms of their Prenuptial Agreement
- Parties who want to update their Prenuptial Agreement due to the passage of time
- Parties who are married and wish to make plans for the division of their assets in the event of a divorce
Similar to a prenup, child custody cannot be negotiated into a Post-nuptial agreement. Custody requires consideration of the best of the child(ren).
